KVKK PRIVACY NOTICE

 

As Zero Second Bilişim Sistemleri ve Danışmanlık Hizmetleri Limited Şirketi ("Zero Second" or the "Company"), we value the confidentiality and security of your personal data. Accordingly, informing you about your personal data by fulfilling our obligation to inform under Article 10 of the Personal Data Protection Law No. 6698 (the "Law" or "KVKK") is our top priority.

This Disclosure Notice has been prepared by Zero Second, the data controller under the Law, regarding the use of personal data obtained from data subjects who receive services from Zero Second or are potential buyers of its products or services (hereinafter the "Customer") and/or from third parties, in order to inform you transparently about how your personal data is collected, the purposes and legal grounds of the processing activities, the principles of any transfer of personal data, and your rights as a data subject.

(Zero Second may update and amend the provisions of this Disclosure Notice at any time by publishing them elsewhere. Updates and amendments made and/or to be made by Zero Second will be effective from the date of publication.)

Although the types and amount of personal data processed in connection with your business relationship with Zero Second vary depending on the reason for processing, the personal data you share with the Company or that the Company obtains from third parties is categorized below:

• General Principles:

In accordance with the general principles set out in Article 4 of the KVKK, your personal data is processed by Zero Second lawfully and in good faith, accurately and kept up to date where necessary, for specific, explicit and legitimate purposes, in a manner relevant, limited and proportionate to the purposes for which it is processed, and retained for the period stipulated in the relevant legislation or required for the purpose of processing.

• Purposes of Processing Personal Data:

The Company processes your personal data covered by this Disclosure Notice for the following purposes: conducting audit/ethics activities, conducting activities in compliance with legislation, conducting finance and accounting operations, following up and conducting legal affairs, conducting communication activities, conducting/auditing business activities, conducting logistics activities, conducting goods/services procurement processes, conducting goods/services after-sales support services, conducting goods/services sales processes, conducting goods/services production and operation processes, conducting customer relationship management processes, conducting customer satisfaction activities, conducting marketing analysis, conducting contract processes, following up requests/complaints, ensuring the security of movable property and resources, conducting product/service marketing processes, ensuring the security of data controller operations, providing information to authorized persons, institutions and organizations,  and conducting risk management processes.

 

3. METHODS OF COLLECTING PERSONAL DATA AND LEGAL GROUNDS

 

Your personal data may be collected, processed and transferred by the Company for the purposes stated in this Disclosure Notice, in accordance with the basic principles of the KVKK and within the personal data processing conditions listed in Articles 5 and 6 of the KVKK, through channels such as the conclusion of contracts for the purchase of products or services, participation in advertising campaigns and promotions run by the Company, recording of requests and applications received by the call center, completion of forms on the website and/or social media platforms, and official request letters from public authorities.

4. TRANSFER OF PERSONAL DATA AND PURPOSES OF TRANSFER

 

In compliance with the rules of Article 8 ("Transfer of Personal Data") and/or Article 9 ("Transfer of Personal Data Abroad") of the KVKK, with the necessary technical and administrative measures in place, and only to the extent necessary for and limited to the purposes listed above, your personal data may be transferred:

 

• To our affiliates and subsidiaries,

• Within the scope of contracts concluded between you and the Company and in compliance with legislation, for the purposes of conducting accounting processes, insuring products sent to Customers, completing customs procedures, obtaining quotations and preparing payment plans on behalf of the Customer and conducting related leasing processes, conducting independent audit processes, conducting legal processes, issuing invoices and e-invoices, fulfilling invoice-related obligations, fulfilling audit obligations, conducting bank letter of guarantee, letter of credit and cheque/promissory note processes, and conducting logistics and shipping operations, to our business partners, suppliers, financial advisor, insurance companies, leasing companies, customs brokerage firms, banks, logistics and cargo companies,  and independent audit firms,

• To authorized persons, public institutions and law firms as required by legal regulations and legislation in order to fulfil our legal obligations.

• Your data may also be recorded in our programs and/or systems provided by or made available to us by our technology infrastructure suppliers.

 

 

5. RIGHTS AND OBLIGATIONS OF THE DATA SUBJECT

You may submit your requests/applications under Article 11 of the Law, "which regulates the rights of the data subject", to Zero Second via the "Data Subject Application Form" available on the www.zerosecond.com.tr website. Depending on the nature of your request, your application will be concluded free of charge within thirty days at the latest. However, if the process requires an additional cost, a fee may be charged according to the tariff determined by the Personal Data Protection Board.
